What are the penalties under GDPR?

The penalties provided by the General Data Protection Regulation (GDPR) are enforced following inspections or complaints, especially when data controllers or data processors do not comply with the provisions of the GDPR or the law.
The restricted committee of the CNIL (French Data Protection Authority) can take various measures in case of non-compliance. These sanctions include:
- Issuing a warning.
- Ordering compliance with data processing.
- Temporarily or permanently limiting a data processing activity.
- Suspending data flows.
- Requiring compliance with requests for the exercise of individuals' rights.
- Administrative fines: In case of serious breaches, pecuniary sanctions can be imposed. According to the GDPR, these fines can reach up to €20 million or 4% of the company's annual global turnover, with the higher amount being applied.
It's important to note that these sanctions can be made public, thus increasing transparency regarding GDPR compliance and enforcement actions. The CNIL plays a central role in applying these sanctions to ensure the respect of individuals' rights and privacy.
